Terms of Service – FarmSmart 

FarmSmart is a brand of TeeOne Holidays Private Limited (“TeeOne”).  Please read the terms of this 

 Term of Service Agreement carefully. By using the Platform – www.farmsmart.in ("Website"), or the FarmSmart mobile application on iOS or Android devise 

including phones, tables or any other electronic devise ("FarmSmart App") or the mobile site, 

www.m.farmsmart.in ("Msite"), whereas the Webste, the 

FarmSmart App and the Msite are together referred to as (the "Platform"), or purchasing products from 

the Platform you agree to be bound by all of the terms and conditions of this Agreement.

 

This Agreement governs your use of this Platform, offer of products for purchase on this Platform, and / 

or your purchase of products available on this Platform. 

 

For the purposes of this Agreement, wherever the context so requires "You" or "User" shall mean any 

person including any natural or legal person who uses the Platform or buys any product from the Platform 

using any computer systems or other devices including but not limited to any mobile device, handheld 

device and tablets. 

 

This Agreement includes, and incorporates by reference, the policies and guidelines referred to in this 

Agreement.  In the event of any conflict between the terms of this Agreement and any provision of such 

polices and guidelines, the terms of this Agreement shall prevail in relation to the subject matter hereof 

and the terms of such polices and guidelines shall prevail in relation to the subject matter thereof. You are 

strongly advised to carefully read all such policies and guidelines, as available on the Platform. 

 

TeeOne reserves the right to amend the Agreement at any time by posting such amendments or the 

amended Agreement on this Platform. 

 

TeeOne encourages you to review this Agreement whenever you visit the Platform to make sure that you 

understand the terms and conditions governing the use of the Platform and / or the purchase of products. 

This Agreement does not alter in any way the terms or conditions of any other written agreement you may 

have with TeeOne for other products or services. In the event of any conflict between the terms of this 

Agreement and any other agreement executed with you, the terms of such other agreement shall prevail in 

relation to the subject matter thereof 

 

If you do not agree with this Agreement (including any policies or guidelines referred to herein), please 

immediately terminate your use of the Platform. If you would like to print this Agreement, please click 

the print button on your browser toolbar. 

 

TeeOne grants customers limited access rights for personal use on this Platform and not to download 

(other than page caching) or edit any portion of it or to access its contents to collect and use of product 

listings, descriptions, or prices; any derivative use of this site or any use of data mining, robots, or similar 

data gathering and extraction tools.  Further no Customer is authorized to frame or utilize framing 

 

 

techniques to enclose any trademark, logo, or other proprietary information (including images, text, page 

layout, or form) on the Platform without express written consent.  Any unauthorized use automatically 

terminates the permission granted by TeeOne 

 

 

TERMS OF OFFER 

This Platform offers for sale various products including food products (the "Products"). By placing an 

order for Products through this Platform, you agree to the terms set forth in this Agreement. 

 

The site provides for registration process to serve its Customer better and may now or in the future collect 

the following personally identifiable information to serve you better: a) Name including first and last 

name; b) email address; c) mobile phone numbers and contact details; d) Postal Pin code; e) Personal 

demographic profile like your age, gender, occupation, location, education, address etc., By completing 

the registration or placing an order, the Customer agrees to receive promotional and transactional 

communication, text messages, mobile notifications, phone calls and newsletters. The Customer can opt 

out by contacting the customer service at care.farmsmart@gmail.com We will never sell or provide your 

information to third party companies or outside agencies for commercial purposes.  However, the 

Platform may contain links to other web sites that we do not manage directly such as Google Analytics 

used to understand and optimize users behavior. TeeOne shall not be responsible for the privacy policies 

of such external web sites. 

 

Persons who can form legally binding contracts under Indian Contract Act, 1872 (Act) are only eligible to 

use the Platform.  Persons who are "incompetent to contract" within the meaning of the Act are not 

eligible to use the Platform. If you are under the age of 18 years (minor), you shall not register as a user 

and shall not transact on or use the Platform.  Legal guardian or parents can transact or use the Platform 

on behalf of minor.  TeeOne reserves the right to terminate your membership and/or refuse access to the 

Platform upon acquiring actual knowledge that you are under the age of 18 years. Use of Platform; 

TeeOne is not responsible for any damages resulting from use of this Platform by anyone. You will not 

use the Platform for illegal purposes. You will (1) abide by all applicable local, state, national, and 

international laws and regulations in your use of the Platform (including laws regarding intellectual 

property), (2) not interfere with or disrupt the use and enjoyment of the Platform by other users, (3) not 

resell material on the Platform, (4) not engage, directly or indirectly, in transmission of "spam", chain 

letters, junk mail or any other type of unsolicited communication, and (5) not defame, harass, abuse, or 

disrupt other users of the Platform.  

 

TeeOne has proprietary rights and trade secrets in the Products.  All materials, including images, text, 

illustrations, designs, icons, photographs, programs, music clips or downloads, video clips and written 

and other materials hosted on the Platform (collectively, the "Promotional Material") are intended solely 

for customer convenience. The Platform and all software used in Platform is the property of TeeOne or its 

licensees and suppliers and protected by copyright laws.  

The Platform is to be used only as a shopping resource. Any other use, including the reproduction, 

modification, distribution, transmission, and republication, display, of the Products on the Platform is 

 

strictly prohibited.   

 

PLATFORM

By posting, storing, or transmitting any content on the Platform, you hereby grant TeeOne a perpetual, 

worldwide, non-exclusive, royalty-free, assignable, right and license to use, copy, display, perform, create 

derivative works from, distribute, have distributed, transmit and assign such content in any form, in all 

media now known or hereinafter created, anywhere in the world. TeeOne does not have the ability to 

control the nature of the user-generated content offered through the Platform. You are solely responsible 

for your interactions with other users of the Platform and any content you post. TeeOne is not liable for 

any damage or harm resulting from any posts by or interactions between users. TeeOne reserves the right, 

but has no obligation, to monitor interactions between and among users of the Platform and to remove 

any content TeeOne deems objectionable, at its sole discretion.  TeeOne shall be under no obligation (1) 

to maintain any comments in confidence; (2) to pay you any compensation for any comments; or (3) to 

respond to any comments.  TeeOne reserves the right (but not the obligation) to monitor and edit or 

remove any comments submitted to the Platform.  TeeOne does not take any responsibility or assume 

liability for any Feedback submitted by Customers or any third party. 

 

ORDERING AND PRICING 

The quantity of any Product ordered by you and the quantity of Product supplied to you may vary. Please 

note that while we take utmost care to supply exact quantity of Product ordered by you, due to the nature 

of Products, it is not possible that the exact quantity of Product that you have ordered will be supplied. 

 

Pricing   

 

Prices displayed for all the products on the Platform exclude GST.  Prices for our Products are subject to 

change without notice. We reserve the right at any time to modify or discontinue the Products (or any part 

or content thereof) without notice at any time. We shall not be liable to you or to any third-party for any 

modification, price change, suspension or discontinuance of the Products. 

 

Order Cancellation  

A Customer can opt to cancel order within 1 hour for the order placed either online or by calling our 

customer service and receive refund of advance paid if any. 

 

TeeOne reserves the right to cancel any order if it suspects any fraudulent transaction by a Customer or 

breaches the terms & conditions of using the Platform 

 

Return & Refunds   

TeeOne believes in customer satisfaction and will refund the amount paid for issues relating to quality of 

its supplies. Given that the orders are lower in size and its hard to refund for cash on delivery orders in 

 

particular, the refunds will be applied to the subsequent shopping bills.  

 

DELIVERY 

It is our concept to deliver fresh products, the delivery timing and delivery slots will be available on the 

Platform for the customer to make a choice.  Based on customer selection, we will deliver the Products in 

the time slots selected by the customer.  FarmSmart will not be responsible for any delays that are beyond 

the control of FarmSmart including but not limited to traffic delays, change in weather, road obstructions 

etc.  

 

Objectionable Material  

While all IT security measures are taken to ensure wholesome and socially acceptable content is available 

on the Platform, notwithstanding the best efforts the customer understands and accepts the risk that while 

using this Platform or any services provided on the Platform, one may encounter Content that may be 

deemed by some to be offensive, indecent, or objectionable, which Content may or may not be identified
